Here is what my legal friend says.

Just a little note though. He isn't specialized in IT stuff but has done the research and asked his colleagues.

He says;

You can sell any product that doesn't endanger the users or those around them. This is health and safety 101. You can sell "hacking" software on the grounds that you inform your users of what they are doing and that they understand what is happening. You should also have a disclaimer but its not 100% needed.

In short you cant sell stuff that will physically harm someone or sell to users that don't have a clue. So they can't claim in court; "I didn't know what I was doing. So and so just told me to do it."

And thats about it
He's going to send me a e-mail later on in the week with more information

You should be fine

Really I'm not, this is as old as Dinosaurs. Or at least over 10 years old. You can see that CVE has it (arp spoofing) posted here: http://www.cvedetails.com/cve/CVE-1999-0667/
